Re: Support Global Policy to End Violence against Indigenous Women and Girls

Your Excellencies,
We open this letter by acknowledging all the indigenous women who have been murdered, violated and are missing, in all areas of the world. They are our friends, our daughters, our sisters and our mothers. They are our cousins and neighbors. To most of the world, these sacred souls are invisible. Not to us, which is why we are writing to you.
Violence against indigenous women is astronomically high. The World Bank estimates that 68 percent of indigenous women in Ecuador have experienced violence. In Cameroon, violence against two indigenous communities is estimated at 55 percent. Eighty-four percent of American Indian and Alaska Native women have experienced violence in their lifetime, while indigenous women in Canada are almost seven times more likely to be murdered by an acquaintance than non-indigenous women. In 2020, 889 indigenous women were raped in Bangladesh, a number that is believed to be underreported.
In Canada, indigenous women face disproportionately high levels of violence. Despite making up a small percentage of the population, indigenous women are far more likely to experience violence, go missing, or be murdered than non-indigenous women. This crisis is rooted in historical injustices and systemic discrimination —a part of ongoing colonial legacies and social inequalities that continue to marginalize indigenous communities. Addressing this issue requires a concerted effort to recognize the unique challenges indigenous women face and to implement meaningful change through policy, support, and reconciliation.
Many nations have committed genocide against native indigenous populations and established an oppressive, racist and discriminatory social system that has worked to erase our identities and cultures, and continues to do so. Such violence takes many forms, such as the removal of indigenous children from our homes in the name of “education/civilization” and, recently, safety, land confiscation and invasions, displacement, and deforestation for development and business. Rape, murder, and sexual harassment has been and is used as tools to intimidate us, stripping us of our dignity and the rights the UN works to ensure for all human beings. In Guatemala, for example, 88 percent of women survivors of rape and torture during the civil war were indigenous. In some nations, such as in Bangladesh, we are not even allowed to call ourselves with the term we choose and prefer — indigenous peoples.
The intersecting reality of discrimination against us for being indigenous and for being women means not only are rates of violence against us higher, seeking help and getting justice is difficult. We have less access to education, employment and healthcare. In shelters in a province in Canada, for example, indigenous women comprise 70 percent of the women, while the indigenous population is 16 percent, a result of high rates of violence plus added economic and social marginalization.
Indigenous women and girls face violence from non-native men and boys, as well as men from our communities. In Bangladesh where one of us works to secure justice for indigenous women, it is not unusual for indigenous men to threaten women and girls on social media and share their names and phone numbers. It is socially acceptable for indigenous men who disapprove of an indigenous woman or girl’s attire, lifestyle or activities to threaten the indigenous woman or girl and her family. There have been instances when a group of indigenous men have beaten up indigenous women and girls in the name of “protection.” The violence occurs because the power has traditionally been in the hands of the men, though we are slowly changing this.
What can we do to stop this? What can we do to make the world see our situation and work toward change? We, indigenous women’s rights activists across the globe, need this violence to be out into the light, everywhere. We believe the most promising path is through a treaty in the form of an Optional Protocol to CEDAW specific to ending violence against women and girls.
An Optional Protocol to CEDAW specific to ending violence against women and girls will push states to recognize indigenous women and girls with their own identities, a crucial first step in ending this violence. Second, a treaty would make the horrendous violence against indigenous women and girls visible. In some indigenous communities, there is no place to talk about what is happening, which keeps violence hidden and unaddressed. A treaty would give us a platform for this crucial dialogue and allow us to change the narrative for indigenous women and girls.
A treaty would also work to address the culture of impunity that permeates most nations when it comes to violence against us. For example, In Bangladesh, 57 cases of violence were filed by indigenous women between 2010 and 2011, and not a single verdict was rendered. In some countries, indigenous women cannot even lodge a complaint, particularly if the perpetrator is a soldier. The belief is that the woman’s accusation disrespects the entire army; it does not occur to them that it is the soldier who violated and disrespected the woman. A treaty will push nations to improve access to justice at all levels, from reporting to prosecution, for indigenous women, as well as all women.
In many nations, data specific to violence against indigenous women is minimal or non-existent, part of our invisibility and racist practices. Data collection can be part of a new instrument’s metrics-based monitoring and reporting system.
In short, a treaty would give us a tool to further our work — a document we can use to partner with native and government officials to push them to take action.
CEDAW is the right home for this treaty. It is an extraordinarily powerful tool for women’s equality, and its 2022 General Recommendation 39 on the rights of indigenous women and girls was an important and necessary step. A new optional protocol to CEDAW specific to violence against women and girls will strengthen CEDAW’s framework and be binding on states, pushing them to action. It will close the geographic gap created by the three regional instruments, which leave nearly 75 percent of women and girls without protection from a legally binding instrument on violence against women and girls.
An Optional Protocol is urgently needed. Broadly speaking, such a mechanism would mandate interventions widely known to lower rates of violence, particularly when enacted together, including legal reform; training for police, judges, healthcare providers and all others who come into contact with survivors; establishment of survivor support systems; and violence prevention education and national campaigns.
We need global leaders like you to become champions of a binding framework to end violence against women and girls.
We know you believe in human rights, in justice and in the rights of all people and all women, including the rights to indigenous women and girls to live free from violence. We know you believe in the interventions a treaty would mandate. We are asking you to see the power a treaty has to change our lives and the power you have to make it happen. We are asking you to save our lives and the lives of our sisters, daughters, and granddaughters, and your sisters, daughters and granddaughters. We are asking you to join us in hope and to call for an Optional Protocol to CEDAW dedicated to ending violence against women and girls to make the world safer for all of us.
